01 · SCOPE
These General Terms and Conditions govern table reservations and the sale of vouchers via the website balus-mallorca.com. The provider and contracting party is:

By using the reservation and voucher functions, you accept these terms. Any differing terms of the customer shall apply only if we have expressly agreed to them in writing.
02 · RESERVATIONS
You can request a table reservation via the website. A reservation request does not in itself constitute a binding contract. The reservation only becomes binding upon our express confirmation (e.g. by e-mail).
Please inform us in good time if you are unable to attend a confirmed reservation or if the number of guests changes. In the event of non-attendance without prior cancellation (no-show), we reserve the right to reassign the reserved table after a reasonable waiting period. Separate conditions (e.g. a deposit) may apply to special events or larger groups, and these will be communicated to you in advance.
03 · VOUCHERS
Vouchers for use at the BALUS restaurant can be purchased via the website. Unless otherwise stated on the voucher itself, the following conditions apply:
- Vouchers are valid for three years from the date of issue.
- Cash payment of the voucher value or of any remaining balance is not possible.
- If the full value is not used upon redemption, the remaining balance is retained until the end of the validity period and may be redeemed on a subsequent visit.
- Vouchers are generally transferable, unless they were issued on a personalised basis.
04 · RIGHT OF WITHDRAWAL
If you are a consumer, you have a statutory right of withdrawal (derecho de desistimiento) when purchasing vouchers, under the Spanish consumer protection act (Real Decreto Legislativo 1/2007, TRLGDCU) and EU consumer law.
You may withdraw from the contract within 14 days without giving any reason. The period begins on the day the contract is concluded or the voucher is received. To meet the deadline, it is sufficient to send a clear statement (e.g. by e-mail to info@balus-mallorca.com) of your decision to withdraw from the contract before the period expires.
In the event of a valid withdrawal, we will refund all payments received without undue delay and at the latest within 14 days.
Exception: the right of withdrawal lapses once the voucher has already been redeemed or the service has already been used.
Model withdrawal statement: “I hereby withdraw from the contract concluded for the purchase of the following voucher: [name/number]. Ordered on / received on: […]. Name: […]. Date: […].”
05 · PRICES AND PAYMENT
All prices stated are in euros and include the applicable statutory taxes. The price displayed at the time of the order or visit shall apply. Payment for vouchers is made via the payment methods offered in each case. The voucher is issued and sent once payment has been received in full.
06 · LIABILITY
We are liable without limitation for damage resulting from injury to life, body or health, as well as for intent and gross negligence. In all other respects, our liability is limited, within the legally permissible scope, to the foreseeable damage typical of the contract. Statutory consumer protection rights remain unaffected.
07 · APPLICABLE LAW AND JURISDICTION
Spanish law applies. The place of jurisdiction shall be — subject to mandatory consumer protection provisions — the registered office of the provider. If you are a consumer, the mandatory statutory provisions of the State of your habitual residence that apply to you remain unaffected.

08 · DISPUTE RESOLUTION
We endeavour to resolve any disagreements amicably. In the event of a complaint, please contact us directly first at info@balus-mallorca.com. As a consumer, you may also turn to the competent consumer arbitration boards or to the consumer protection authority of the Balearic Islands (Dirección General de Consumo de les Illes Balears). We are neither obliged nor, as a general rule, willing to participate in dispute resolution proceedings before a consumer arbitration board.
